BOMBAY CJ URGED TO EXPEDITE PROBE AGAINST JUDGE NUTAN SARDESAI

PANJIM: Adv. Aires Rodrigues has today urged Bombay High Court Chief Justice Mohit Shah to expeditiously hold an inquiry against North Goa District Judge Ms Nutan Sardesai for her having heard cases in violation of judicial propriety.
Adv. Rodrigues has also sent to the Chief Justice a copy of the recent judgment passed by a Division Bench of the Bombay High Court at Goa comprising of Justice A.S.Oka and Justice F.M.Reis in which certain very serious observations have been made against District Judge Ms Nutan Sardesai.
The observations were made by the High Court while quashing an order passed by her on 29th April 2009 as Principal District Judge, Margao.in a matter connected to the River Princess.
The High Court in its judgment has held that Judge Nutan Sardesai had exercised her discretion contrary to the well settled principles of law and had committed a serious error in appreciating the evidence in the case.
The High Court further held that Judge Nutan Sardesai had totally misdirected and committed an error by directing the Goa government to refund Rs five and half crores to Jaisu Shipping Ltd even though there was no such prayer from the company in their petition.
Adv. Rodrigues has in his letter to the Chief Justice today stated that the observations made in the High Court judgment only confirms the allegations made by him against Judge Ms Nutan Sardesai.
It may be recalled that Adv. Aires Rodrigues had in his complaint to the Chief Justice earlier stated that it was very improper for Judge Nutan Sardesai to have heard matters involving the interests of her former employer Industrialist Mr. Anil Salgaocar.
Adv. Rodrigues had also drawn the Chief Justice’s attention that Judge Nutan Sardesai contrary to judicial propriety and high standards of judicial ethics that is being sought to be laid down by the Supreme Court had also heard a divorce matter relating to her own cousin brother.
