CRIME BRANCH FORWARDS CUDDEGAL MINE DISASTER COMPLAINT TO SP SOUTH

PANJIM: Crime branch has forwarded a complaint filed by three social activists against a mining company, for negligence that led to the death of three workers in a mine at Cuddegal in Sanguem taluka, to the SP (South) to take necessary action as per law.
On June 17, three workers were buried under the debris after a tailing wall of an iron ore mine collapsed due to heavy rains. In their complaint to the crime branch and anti-corruption bureau ( ACB), the complainants alleged that it is the engineering failure of the mining company which makes a prima facie case of negligence against the company.
They also demanded that Sanguem DySP and PI should be booked under the Prevention of Corruption Act for not registering a case against the mining company -- Sociedade de Fomento Industrial Pvt. Ltd --, its owners and officials for causing the death of the three workers for "illegal gratification or other illegal benefits".
SP (crime) Mangaldas Dessai on Friday forwarded the complaint lodged by -- Atish Mandrekar, Kashinath Shetye and Ketan Govekar - to SP (South) stating, "You are aware that Curchorem police station has taken cognizance and registered unnatural deaths under Section 174 CrPC. As such you are requested to act upon the complaint (lodged by the three social activists) as per the law."
In their complaint, the trio alleged that the police officials claim that they have referred the matter to higher authorities is "wholly superfluous and unnecessary" and is just a tactic to delay the registration of an FIR.
Shetye said that if the police fail to register a complaint within a day or two, then they would be forced to approach the magistrate with an application under Section 156(3) of the CrPC. Police have not yet registered the case.
