While Judge Desmond D’Costa has been hauled up for allegedly expeditiously disposing one case against Mahanand Naik, no action has yet been taken against North Goa District Judge Nutan Sardesai against whom there are very serious allegations.
The strictures against her were passed by the Bombay High Court itself in a matter connected to the River Princess which she had heard despite being a former employee of Mr. Anil Salgaocar. The High Court held that Judge Nutan Sardesai had totally misdirected and committed an error by directing the Goa government to refund Rs five and half crores to Jaisu Shipping Ltd even though there was no such demand by the company. The High Court also observed that Judge Nutan Sardesai had exercised her discretion contrary to the well settled principles of law and that she had committed a serious error in appreciating the evidence in the case.
Besides hearing matters involving the interests of her former employer Industrialist Mr. Anil Salgaocar, Judge Nutan Sardesai contrary to judicial propriety and high standards of judicial ethics that is being sought to be laid down by the Supreme Court had also favorably heard a divorce matter relating to her own cousin brother.
It’s time the High Court cracks the whip. We need to also get rid of some other unworthy and highly incompetent judges who continue to be a liability to the justice delivery system.
